Terms of Service

The rules for using Tagura, whether you order from a business or run one.

Effective [Effective date]

Who we are

Tagura is operated by [Company legal name] (“Tagura”, “we”, “us”), [Company mailing address]. These Terms apply to everyone who uses Tagura websites, ordering pages, apps and messages (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you run a business on Tagura, the Business Terms also apply to you.

What Tagura does

Tagura provides software that lets independent businesses take orders, quote requests and bookings and get paid. When you order from a business, your contract for the goods or services is with that business, not with Tagura. The business sets its prices, descriptions, availability, policies, refunds and taxes, and is responsible for what it sells and delivers.

Card payments are processed by Stripe on behalf of the business. Tagura does not store full card numbers.

Accounts and sign-in

You can order as a guest. If you create an account, keep your email account secure, because sign-in codes are sent there. You are responsible for activity under your account. Tell us at once if you think someone else has used it.

You must be at least 18, or the age of majority where you live, to create an account or run a business on Tagura. The Service is not directed to children under 13 and we do not knowingly collect their information.

Orders, quotes and bookings

Prices and availability shown before you pay are estimates until the business confirms, except where the page says the price is final. Quotes are offers from the business; approving a quote forms an agreement with that business on the terms shown, including any deposit and cancellation policy.

Deposits, balances, cancellations and refunds follow the business’s stated policy. Questions or disputes about an order should go to the business first; contact details are on its page and your order page. If you still need help, contact us and we will try to help, but we cannot decide disputes between you and a business.

Messages

We send messages needed to complete your order (for example confirmations, receipts, quotes and reminders). Text messages are only sent if you opt in, and you can reply STOP at any time. See the Text Message Terms.

Acceptable use

Do not misuse the Service. For example, do not break the law, infringe others’ rights, send spam, upload malware, probe or overload our systems, scrape the Service, impersonate others, place fraudulent orders or use stolen payment details. We may suspend or remove accounts, pages or content that break these rules or put people at risk.

Content you provide

You keep ownership of what you upload (such as photos, logos, messages and files). You give Tagura permission to host, copy, display and process it only as needed to run the Service, for example to show your files to the business you ordered from. You confirm you have the rights to anything you upload.

When you upload artwork or a design to be printed or embroidered, you confirm you own it or have permission to reproduce it, including any logos, names, characters or trademarks in it. Previews are a guide: colors, size and placement on the finished item can differ. The business may decline to make anything it believes infringes someone else’s rights or breaks its own policies.

Our service and changes

We work to keep Tagura available and secure, but the Service is provided “as is” and “as available”. We may change, add or remove features. If we make a material change to these Terms we will update the effective date and, where appropriate, notify you. Continuing to use the Service after a change means you accept it.

Disclaimers and limits of liability

To the fullest extent the law allows, Tagura disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and is not responsible for goods or services provided by businesses. Tagura will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid Tagura in the 12 months before the claim or $100.

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Disputes

These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Before filing a claim, please contact us at [legal@yourdomain] so we can try to resolve it informally. Any claim must be brought in the state or federal courts located in [State], unless the law where you live gives you the right to sue locally. Nothing here limits rights you have under consumer protection laws that cannot be waived.
